Punjab & Haryana HC:
Definition of Sikh, hearing adjourned
10/23/2008
The Punjab and Haryana High Court adjourned till November 3 the
hearing on the writ petition challenging the constitutional
validity of a Sikh as contained in the Sikh Gurdwara Act (SGA),
1925.
While adjourning the case, the full bench of Justices Jagdish
Singh Khehar, Jasbir Singh and Ajay Kumar Mittal again directed
the Shiromani Gurdwara Prabandhak Committee (SGPC) to file an
affidavit on the definition of a Sikh as per SGA, 1925, on or
before the next date of hearing.
The petition has been filed by Gurleen Kaur who had been
declined admission to MBBS course at SGPC-run Sri Guru Ram Dass
Institute of Medical Education and Research, Amritsar, under the
quota of seats reserved for Sikh candidates.
She was denied admission on the ground that she was a Patit and
as such, did not fall within the strict definition of the Sikh
adhering to Sikh tenets, as she had plucked eyebrows.
